1. Who these terms apply to
These terms relate to the website and general service information provided by Palmer Edge Marketing FZCO, based in Dubai, United Arab Emirates. The website is also associated with the Leon Palmer Agency name. “We”, “us” and “our” mean Palmer Edge Marketing FZCO; “you” means the visitor or business using the website or engaging our services.
By using the website, you agree to these website terms to the extent they form an enforceable agreement under applicable law. If you do not agree, please do not use the website. Merely visiting, sending an enquiry or booking a discovery call does not commit you to purchasing services.
Our services are intended for adults acting for a business. If you act for an organisation, you must have authority to provide its information and enter into any agreement on its behalf.
2. Your client agreement comes first
The website describes our services in general terms. The scope, fees, deliverables, timetable, responsibilities and any particular commercial conditions for an engagement must be agreed in a written proposal, service agreement or other written acceptance.
If that agreement conflicts with these general terms, the specific client agreement takes precedence for that engagement, subject to applicable law. These terms do not retrospectively change an existing client agreement or create an unagreed charge, renewal period or cancellation requirement.
3. Services and scope
Our work may include paid advertising management, creative development, conversion and funnel optimisation, tracking and attribution review, business growth consulting and AI-assisted production or analysis. Only the services expressly agreed for your engagement are included.
A discovery call is an opportunity to discuss your business and possible next steps. It does not include a complete audit, implementation or ongoing consulting unless agreed separately.
Requests outside the agreed scope may require a revised quotation or schedule. We will seek agreement before undertaking additional chargeable work.
4. Results and performance information
We aim to perform agreed services with reasonable care and skill. Marketing performance depends on factors including your offer, pricing, market conditions, creative, sales process, fulfilment, competition, platform behaviour and budget.
We do not guarantee a particular revenue figure, return on advertising spend, number of leads, bookings or sales. A guarantee applies only if it is expressly set out in a written agreement and subject to its stated conditions.
Testimonials and case studies describe particular client experiences. They are not a prediction of what your business will achieve. Revenue is not profit, and reported return on advertising spend does not automatically account for operating costs, refunds, taxes or other expenses.
Reports may differ because of attribution models, reporting periods, currencies, tracking limitations and platform definitions. Where we show an estimate or calculated figure, it should be read with its accompanying explanation.
5. Fees, ad spend and software
Service fees, payment dates, taxes and any approved expenses are determined by your written agreement or quotation. Advertising spend and third-party charges are separate from our management or consulting fees unless the agreement expressly says otherwise.
We do not supply a HYROS subscription as part of our services. If the engagement uses that platform, the subscription must be purchased separately. The same principle applies to other paid tools, hosting, domains and subscriptions unless expressly included.
Only spending and budgets you authorise may be committed on your behalf. Your agreement should identify how budgets and material changes are approved. Any payment issue or proposed pause will be handled under that agreement and applicable law.
6. Your responsibilities
To enable agreed work, you are responsible for:
- Providing accurate business information, relevant materials and the access needed for the engagement.
- Giving timely decisions, feedback and approvals, and identifying who can authorise changes.
- Having the rights and permissions required for supplied images, videos, testimonials, customer data, trademarks and other materials.
- Ensuring your products, services, claims, offers and fulfilment comply with laws and platform requirements that apply to your business.
- Keeping your accounts secure, using appropriate access permissions and notifying us of relevant changes or suspected compromise.
- Maintaining the sales and fulfilment activities that remain your responsibility under the agreed scope.
Delays, missing access or inaccurate information can affect delivery and performance. We will discuss material effects with you rather than treat every delay as automatic approval of additional fees.
7. Third-party platforms
Advertising, CRM, attribution, email, booking, meeting and other services are operated by third parties. Their availability, policies, prices and functionality can change. Account restrictions, review decisions, delivery interruptions and technical issues may be outside our control.
Where you own a platform account, you remain responsible for its contractual relationship with the provider. We will work within the access and instructions agreed with you. We do not promise that a platform will approve an advertisement, maintain an account or deliver a particular result.
Our website booking process uses HighLevel / LeadConnector, with Google Calendar and Zoom used for scheduling and meeting arrangements. Their own terms apply to use of their services.
8. AI-assisted work
We may use AI tools for research, organising client context, drafting content and advertising, production and analysing information. AI output can contain errors, omissions or material that needs checking. Human review and the approvals agreed for an engagement remain important.
Tell us before work begins about any restrictions on use of your confidential information, personal data or project materials with particular tools. Handling of those materials is subject to applicable law, supplier terms, our privacy policy and any agreed client restrictions.
AI-generated material may not qualify for exclusive intellectual-property protection in every jurisdiction. We do not promise exclusive ownership of underlying models, methods or elements supplied under third-party licences.
9. Accounts and intellectual property
You retain rights in your pre-existing materials and accounts. Providing materials for an engagement gives us permission to use them to perform the agreed work, within your instructions and the rights you are entitled to grant.
Ownership, handover and permitted use of commissioned deliverables are governed by the client agreement. Our general methods, know-how, reusable tools and pre-existing materials remain ours unless expressly transferred. Third-party materials remain subject to their own licences.
The website’s branding, text, design and original materials are protected where applicable law provides protection. You may read and share links to the site for ordinary business purposes. You must not reproduce substantial parts commercially, impersonate us or use our brand in a way that falsely implies an association or endorsement without permission.
Public use of your name, testimonial or identifiable project results requires the relevant permission or other lawful authority; an engagement alone does not give an unrestricted right to disclose your confidential information.
10. Confidentiality and personal information
Our privacy policy explains how we handle personal information collected for our own business purposes. An engagement involving client-controlled personal data may require additional written processing instructions or a data processing agreement.
Confidential business information shared for an engagement should be used for that engagement and disclosed only as authorised, necessary for delivery, or required by law. More specific confidentiality requirements in your client agreement take precedence.
Do not send passwords, identity documents, payment credentials or sensitive personal information through a general enquiry form. Appropriate arrangements should be agreed if the work requires such information.
11. Appointments and communications
Booking is subject to the availability shown by the calendar and a successful confirmation. Please check the selected time zone and the details in your confirmation.
Use the rescheduling or cancellation option supplied with your booking, or contact us if you need help. Any charge for a paid appointment, late cancellation or missed appointment must be communicated and agreed before it applies; this website does not create an undisclosed cancellation fee.
Appointment confirmations and reminders are service communications. Marketing preferences and personal-data choices are addressed in the privacy policy.
12. Cancellation, refunds and suspension
Engagement duration, renewal, notice, cancellation and refund arrangements are determined by the written client agreement and applicable law. We do not impose a universal “no refunds” rule through these website terms.
If you want to end an engagement or believe work has not been delivered as agreed, contact us promptly so we can review the circumstances, completed work, outstanding commitments and any remedy due.
We may need to pause or decline work involving unlawful activity, unsafe access, materially misleading claims, or instructions that breach platform requirements. Any service suspension or termination, and its financial consequences, must be handled consistently with the agreement and applicable law.
13. Acceptable use and website availability
You must not use the website to submit fraudulent enquiries, impersonate another person, upload malicious material, attempt unauthorised access, interfere with its operation or misuse personal information.
We may take reasonable steps to protect the site and its users from abuse. We cannot guarantee uninterrupted access or that every page will always be free of errors. If you notice a problem, please contact us.
General information on the website does not replace advice tailored to your business, and is not legal, tax, financial or other regulated professional advice. Engage an appropriately qualified adviser where that advice is needed.
14. External links and affiliate relationships
Links to third-party sites are provided for convenience or relevant information. We do not control their content, availability or practices, and linking to a site does not make us responsible for that operator’s services.
Some links, including our HYROS link, are affiliate links. We may receive a commission on a qualifying purchase. Your purchase is governed by the third party’s terms; it does not make the software part of our service package.
15. Liability and mandatory rights
Any agreed limitation of liability for paid services should be set out in the client agreement. These website terms do not create a new monetary cap on an existing engagement.
To the extent permitted by law, we are not responsible for losses arising solely from your unauthorised or unlawful use of the website, or a third-party service issue for which we have no legal responsibility. This does not remove our responsibility for our own acts or omissions where applicable law imposes it.
Nothing in these terms excludes liability or limits a right that cannot lawfully be excluded or limited. Mandatory consumer protections and other applicable statutory rights continue to apply. Where a provision is unenforceable, it will apply only to the extent permitted, without automatically invalidating the remaining provisions.
16. Governing law and disputes
Unless a written client agreement provides otherwise, these website terms are governed by the laws applicable in Dubai and the United Arab Emirates, subject to any mandatory protections that apply to you.
Raise a concern with us first at [email protected], with enough detail for us to investigate and discuss a resolution. If it cannot be resolved, the dispute may be brought before a court or other forum with lawful jurisdiction. These terms do not remove a right to complain to a competent authority or use a forum required by mandatory law.
17. Changes and contact
We may update these website terms. The date at the top identifies the latest version. Material changes to an existing engagement require the process specified in the client agreement and cannot be imposed simply by editing this page.
These terms should be read with the privacy policy and any agreement specific to your services. If you are uncertain about what is included in a proposal, ask us before accepting it.
